DENVER (WTW) - Democratic legislation to Colorado employers restrict the use of consumer credit information in hiring decisions received initial approval Monday, but the Republicans and business groups say the bill is bad for business.
More than a dozen States this year are considering similar legislation, and proponents say the bad economy means more people who are unemployed have accumulated bad credit, and finding that they face an obstacle to landing a job is created.
But opponents say that companies should be allowed to use all available information to use them in making hiring decisions and legislation opens them up to lawsuits by disgruntled applicants.
The proposal is the first hurdle in committee Monday with Republicans voted against it on a party-line vote. Republicans will play a greater role in deciding the fate of the legislation if it is to the GOP-controlled House to be.
Democratic Sen. Morgan Carroll, the bill sponsor, said employers need to base hiring decisions on the work of the history and job interviews, no credit scores, in the aftermath of the recession.
"If we want a permanent class of unemployed and employable people in this state?" Carroll, of Aurora, asked legislators in the committee vote on the bill.
Republican lawmakers are not sold on the idea Carroll and wondered whether it is the state's role to be involved in private renting decisions.
"In a free market capitalist system, not the employer, not the state government, to decide what weight or lack of weight on one small aspect of the recruitment process to give?" asked Mesa County Republican Senator Steve King.
Carroll's bill would limit the use of consumer credit information from potential employees, unless they apply for a job that is financial decisions. It would also require employers who use credit information to potential employees the opportunity to explain any negative information.
The legislation would allow people to pursue civil proceedings if an employer wrongfully used their credit card information against them.
Tony Gagliardi, Colorado and Wyoming state director of the National Federation of Independent Business, called the bill a government "too far" that would discourage job creation.
"The bill exposes employers to lawsuits by employees or potential employees just because they feel they would have passed for a promotion or employment," he said, adding that the legislation "does nothing but increase gray areas for employers to justify their hiring decisions. "
Carroll said the recession has the necessary legislation.
"Do you know someone who has a job loss, losing an income and maintaining a good credit score?" she asked.
Nineteen states and the District of Columbia have introduced legislation this year dealing with credit checks in employment, according to the National Conference of State legislatures. From 34 accounts are considered, 32 deal with restrictions on the use of credit information for employment decisions.
Florida, Georgia, Massachusetts, New York and Wisconsin are among the states considering legislation.
